Welcome to Zen. These Terms of Service ("Terms") are a binding agreement between you and Zen Financial Group LLC ("Zen," "we," "us," or "our") governing your use of our website and mobile app (together, the "Services"). Please read them carefully. By creating an account, joining the waitlist, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Services. The Services are intended for users in the United States and Canada. By using the Services, you represent that you meet these requirements.
Zen is a personal net-worth and portfolio tracking and information tool. It aggregates and displays information about assets you own and surfaces relevant news. Zen is not a broker-dealer, investment adviser, financial planner, bank, or money transmitter. Zen does not custody your money or assets, does not execute trades, and does not provide personalized investment, financial, tax, or legal advice. The Zen Score and AI news feed are informational only. See our Disclosures, which are incorporated into these Terms.
The Services rely on third parties, including Plaid for account connectivity and various market-data and news providers. Your use of connected accounts is also subject to those third parties' terms and privacy policies. We do not control and are not responsible for the accuracy, completeness, timeliness, or availability of third-party data, which may be delayed or contain errors.
You agree not to:
The Services, including all software, design, content, the Zen name and logo, and the Zen Score methodology and AI news-matching technology, are owned by Zen Financial Group LLC and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use. All rights not expressly granted are reserved.
If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES OR ANY DATA (INCLUDING PRICING, THE ZEN SCORE, OR NEWS) WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, OR ERROR-FREE. YOU USE THE SERVICES AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEN FINANCIAL GROUP LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR INVESTMENT LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Zen Financial Group LLC from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms.
Please read this section carefully — it affects your legal rights. Except for small-claims matters, you and Zen agree to resolve any dispute relating to the Services through binding individual arbitration, and not in court. You and Zen waive the right to a jury trial and to participate in any class or representative action.
30-day opt-out: You may opt out of this arbitration agreement by emailing support@zen-fi.com within 30 days of first accepting these Terms, with your name and a statement that you wish to opt out. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, and the Federal Arbitration Act governs the interpretation and enforcement of this Section.
You may stop using the Services at any time and request account deletion. We may suspend or terminate your access if you violate these Terms or to protect the Services. Sections that by their nature should survive termination (including Sections 6, 8, 9, 10, 11, and 13) will survive.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Subject to Section 11, the state and federal courts located in the State of Florida will have exclusive jurisdiction over any matters not subject to arbitration.
We may update these Terms from time to time. For material changes, we will provide notice (for example, by email or in-app). Your continued use of the Services after the changes take effect constitutes acceptance.
If you download the app from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement (LAEULA). Apple is a third-party beneficiary of these Terms and may enforce them. Apple is not responsible for the app or any claims relating to it.
